- How long does the trademark registration process take?
3 to 6 months for applications that don't face oppositions. The period includes 60-90 days of substantive examination, followed by publication in the Official Gazette with a 60-day opposition window, then issuance. Oppositions or observations may extend the timeline.
- What is the trademark protection duration?
Ten years, renewable indefinitely. The trademark must be renewed before protection expires to avoid loss of rights. If renewal is delayed more than 6 months, a new registration application is filed under the same commercial registration with documents proving ownership.
- What is the difference between a trademark and a trade name?
A trade name protects the company name before the Ministry of Commerce. A trademark protects the identity before the consumer in a specific class of goods or services. The two complement each other and are registered with two different entities.
- Does the service cover foreign companies?
Yes. We serve Saudi and foreign companies. Foreign companies without a Saudi entity register through a licensed Saudi agent (Motaded Limited), with a legal power of attorney attested by the Saudi embassy in the country of origin and certified Arabic translation of documents.
- How much does the service cost?
Accordion content.SAIP government fees start at SAR 1,000 per class (filing) and SAR 1,575 (publication and issuance). Our professional fees vary by service scope (number of classes, preliminary search, attestations, translation). The final quote is determined after the initial consultation.
- Does the service include GCC country registration?
Saudi registration is independent from other Gulf countries. For full GCC protection, separate registrations in each country are needed, or the Madrid international system via WIPO can be used for one registration covering multiple countries. We coordinate this as additional services.
- What happens if the application is rejected?
If a provisional objection is issued by a SAIP examiner, we handle the legal response within the specified period. If rejection persists, appeal is possible before SAIP's grievance committee, then before the Administrative Court. Many objections can be overcome with simple application amendments.
- Can a trademark be registered without an existing company?
Saudi individuals can register with their national ID. Companies must have a valid commercial registration. For foreigners wishing to register before establishing their Saudi entity, filing in the name of the parent company abroad through a Saudi agent is possible, then transferring ownership later.
